      Frequently asked questions

No. Our injury cases are handled on a contingent retainer. You pay nothing upfront, and we recover attorney’s fees only if your litigation is successful. We don’t bill by the hour. You don’t need to worry about running up a large attorney’s bill before you see any recovery for your injuries.

Yes. Our firm is dedicated to creating a strong relationship with our clients, beginning with keeping your information and consultation confidential.

Each case we encounter is carefully screened and evidence scrutinized to make sure the claim is meritorious and may be successful at trial. We will perform an investigation, and then our partners make a final decision on whether to take on a case.

      Duffy & Duffy Law

Ben has spent his entire career representing victims of medical malpractice and has recovered millions of dollars for his clients. Initially, Ben focused on representing infants who were injured during or shortly after birth. During this time, in 2015, Ben was the litigation attorney on a birth injury case that resulted in a $135 million dollar verdict on behalf of a severely brain damaged infant. He then spent the next part of his career litigating all varieties of medical malpractice cases, ranging from surgical complications to strokes. More recently, Ben conducted over ten depositions on a complex stroke case that settled for $2.2 million and settled a drop foot case for $975,000 (both upstate, difficult venues for plaintiffs). He has been named a Super Lawyer – Rising Star in plaintiff’s medical malpractice from 2015 through 2024 (Each year, no more than 2.5 percent of the lawyers in the state are selected by the research team at Super Lawyers to receive this honor). He is a member of the New York State Trial Lawyers Association. Ben received a Bachelor of Arts in Philosophy and a Bachelor of Arts in Philosophy, Politics, and Law from Binghamton University in 2008. He was a member of Binghamton’s Division I Men’s Track and Field Team for four years and competed in the discus, hammer, and the weight. Ben went on to receive his Juris Doctor from Penn State Law in 2011. He was an Articles Editor on the Penn State International Law Review (now the Penn State Journal of Law and International Affairs). Ben resides in Brooklyn with his wife.
